CCTA (CDTOA) v. CARB & EPA – Lawsuit Updates (6-14)

The CCTA appeal of Judge England’s ruling is still pending in the Ninth Circuit Court. Briefing on that case was completed in August, 2013, so it has been pending for about 10 months.

This is not particularly unusual; our counsel has seen cases pend for close to two years. In one recent F4A case they handled for the towing industry, the case was in the Ninth Circuit for 18 months before an opinion was issued. In any event, there are no statutes or rules governing the time in which the court must decide a case.

The next step will be for the court to schedule oral arguments.

Named 2014 Citizen Driver Award Winners

TravelCenters of America and Petro Stopping Center recognized association members Bob and Linda Caffee of Silex, MO. with the second annual Citizen Driver Award by renaming the Petro Stopping Center in North Las Vegas the “Bob and Linda Caffee Petro Stopping Center.” They were one of seven drivers selected in March at the Mid-America Truck Show in Louisville, KY. for this recognition. The Affordable Care Act for O-Os Update

The Act also known as ObamaCare created new options for owner-operator independent contractors in trucking to purchase health insurance, though it also poses some important questions.
Owner-operators and independent contractors are classified as “self-employed” and as such have not qualified for employer-provided health coverage. While some receive coverage through a spouse’s employer, others are turned down due to pre-existing conditions and have gone on without any type of insurance. Read more
