Program Updates – June / July 2014

The CCTA scholarship committee and CCTA staff is proud of Teddi and sharing in the joy of her success. Teddi is the recipient of several CCTA scholarships over the past four years. This young lady is not only daughter of Doug and Mickie Nichols, who are very active within the association, but Teddi attends scholarship fundraisers when she is not hard at work with her school responsibilities and duties. She also volunteered to help guide new scholarship applicants with the application process. Congratulations and keep up the good work. We expect to hear great things about all your future accomplishments. Read more

C.B. Rambo’s, Electronic Media and the Loss of Civility

Regardless of how you parcel-out these issues and find one word to explain it all – “disingenuous” keeps coming to mind. Let’s review the recent events I’m talking about:

1.) A call for FMCSA Administrator Anne Ferro’s resignation and a letter from a group of owner-operators opposing the effort;

2.) a push in the U.S. Senate to relax the 34-hour restart provision,

3.) an almost total lack of honesty by the trucking media in communicating what a related Senate Bill contained; and

4.) a horrific truck crash on the New Jersey Turnpike seriously injuring comedian Tracy Morgan and killing another. All unconnected events but how they were communicated and commented on by truckers in particular, showed an ugly side of an industry desperate to be taken seriously by the public and politicians, yet once again becoming its own worst enemy. Another Great Board Meeting

I read both Susan and Lee’s articles about the Board meeting and didn’t really want to repeat anything that they had already reported on. Yet, I do want to congratulate all our board members and guests who made the Summer Board Meeting in Sacramento a success. So much work goes into planning these meetings as we strive to bring you the latest issues and educational content that concerns our industry, and I believe we accomplished this mission again. CCTA Board Approves “Subdivisions” Section Addition to the Bylaws

Over the last six months, we have been discussing the need to modernize the Associations’ bylaws, as our organization has gone through many changes over the last few years. A variety of situations piqued the issue and we were forced to begin changing the bylaws now. It started when numerous questions were asked and issues arose about all of our existing conferences and alliances, some of which (Heavy-haul Conference) are over 10 years old. Read more

Good News from the Summer Board Meeting

We had a rather full agenda at our Summer Board Meeting in Sacramento, as it was again dominated by CARB regulation issues and a host of legal theories involving legal actions and as usual our attempts to decipher CARB’s regulatory chaos. One theme that was common through the discussions was just how screwed-up and confusing the regulations are. Regardless of whether you are now for them or still against them – they are a mess! Watching CCTA Grow

What a wonderful Board meeting we had Saturday June 21st in Sacramento! Once again your Association went all out, inviting fantastic speakers who presented a variety of information from insurance issues to CARB regulations and related legal strategies of all shapes and sizes. One thing is for sure; CCTA continues to grow in size, reputation and even national relevance in our fight with CARB and EPA. We also have gained industry respect through our positions and comments on the Drug and Alcohol Clearinghouse, Electronic Logging Devices, Hours of Service etc..

I also wanted to give kudos to the staff, on another great job putting the meeting, speakers and food choices together. Read more

CCTA (CDTOA) v. CARB & EPA – Lawsuit Updates (6-14)

The CCTA appeal of Judge England’s ruling is still pending in the Ninth Circuit Court. Briefing on that case was completed in August, 2013, so it has been pending for about 10 months.

This is not particularly unusual; our counsel has seen cases pend for close to two years. In one recent F4A case they handled for the towing industry, the case was in the Ninth Circuit for 18 months before an opinion was issued. In any event, there are no statutes or rules governing the time in which the court must decide a case.

The next step will be for the court to schedule oral arguments.

The Affordable Care Act for O-Os Update

The Act also known as ObamaCare created new options for owner-operator independent contractors in trucking to purchase health insurance, though it also poses some important questions.
Owner-operators and independent contractors are classified as “self-employed” and as such have not qualified for employer-provided health coverage. While some receive coverage through a spouse’s employer, others are turned down due to pre-existing conditions and have gone on without any type of insurance. Read more
